1. Acceptance of the terms
By accessing or using this website (hereinafter referred to as the “Site”), you agree to these Terms of Use (CGU). If you do not agree with these Terms, please do not use the Site.
2. Use of the Site and the Application
The Site is intended to provide information about tourist activities to do in your area and to make it easier to search for these activities. You agree to use the Site only for lawful purposes, in accordance with applicable laws and regulations.
The Yutugo® application is intended for users who use it for purely recreational purposes and for sharing knowledge and information related to culture, history and tourism in the context of their personal activity.
The Yutugo® application can be downloaded free of charge from legal application download platforms,
such as the Google® Play Store for the Android version. Please note that downloading
the Yutugo® application may also require the creation of an account on the relevant platform.
We recommend that you consult the specific terms of use of that platform for more detailed information.
To download and install the Yutugo® application, please make sure that your device meets at least the following:
- Free storage space on the device: 100 MB
- Active Internet connection.
All services provided via the Yutugo® application and/or the Yutugo® website are free of charge. However, the devices used to access and use the services, as well as all electronic communication costs (such as telephone charges and Internet access fees) related to this use, remain entirely at the expense of the Internet user / user. It is the responsibility of the Internet user / user to check the applicable tariffs with the relevant operators. The Internet user / user is solely responsible for paying these costs.
In order to benefit from the service that provides access to points of interest and associated content, the user must authorise the use of geolocation data. The geolocation settings can be changed at any time by the user in the “Settings / Location services” (or similar) section of the device operating system. Based on the position and the selected categories, the user can view points of interest and associated content that are automatically suggested by the Yutugo® application. The points of interest available in the Yutugo® application are based on open data and contributions from other users. Some of the content associated with points of interest may be protected works (in particular multimedia works) for which Clerice Network is the holder or right holder. The quality, relevance, accuracy, safety and lawfulness of any point of interest and associated content, as broadcast on the Yutugo® application, remain the sole responsibility of their authors. Clerice Network does not perform general monitoring or permanent control of the points of interest and the content that may be associated with them.
Clerice Network undertakes to implement all technical means necessary to guarantee secure access, consultation and use of the media (Site and application), in accordance with standard Internet practices. The media are accessible 24 hours a day, 7 days a week, except in case of force majeure or events beyond the control of Clerice Network, and during maintenance operations required for the proper functioning of the media. Clerice Network provides the infrastructure and technical means needed to guarantee the quality of the service for users who have a device that complies with the requirements set out in these Terms. However, Clerice Network is not responsible for malfunctions of the user device or compatibility issues between the media and the device. Clerice Network also declines any liability in case of failures, interruptions or malfunction of the user Internet access services, as well as for any external cause that may disrupt or damage access to the services.
The user acknowledges and accepts the characteristics and limitations of the Internet, in particular in terms of responsibility and security. The user is solely responsible for his or her use of the media, for any downloads and for protecting his or her own data against viruses that may circulate on the media. No advice or information, whether oral or written, obtained when using the media can create any guarantees that are not expressly provided for in these Terms. The user is solely responsible for his or her use of points of interest and the content available in the Yutugo® application, and Clerice Network declines any liability for direct or indirect damage that may result from such use. It is the responsibility of the user to make sure that the technical characteristics of the device allow access to the Yutugo® application and use of the services. The user must have a secure email address, and transmission speed depends on electronic communications networks and the technical characteristics of his or her Internet connection (Wi-Fi, Edge, 3G, 4G, 5G, etc.).
Uninstallation of the Yutugo® application by the user: the user may uninstall the Yutugo® application from his or her device at any time, without prior notice. However, this means that the user will no longer have access to the Yutugo® application, to the services or to any contributions, unless the application is downloaded again.
Suspension / Termination of the account / services by Clerice Network in case of breach of these Terms of Use by the user: in case of breach of these Terms of Use by the user, Clerice Network reserves the right to temporarily suspend and then automatically terminate access to the services and to the user account. Clerice Network may suspend access to the services and to the account for the time necessary for checks by its customer service, following a report or in case of suspected breach of these Terms that can be remedied.
The user will be informed of the suspension of access to the services and to the account by a notification sent via the Yutugo® application or by email. The user is invited to contact the customer service of Clerice Network by email to obtain further information about the reasons for the suspension, to provide comments and/or to prove that the breach has been remedied. If, within 30 days from the notification of suspension, the user has not contacted customer service or if the elements provided do not make it possible to resolve the breach, Clerice Network may notify the user of the termination of access to the services and to the account via the Yutugo® application and/or by email.
The user will be informed of the period during which he or she will not be allowed to register again on the Yutugo® application, which is generally set at one (1) year from the notification of termination. In all cases, when an account is deleted, the user authentication data is kept for one (1) year for legal purposes, then permanently deleted after that period. Other data and account content will be anonymised immediately, and user contributions may be deleted. After these retention periods, Clerice Network can in no case be held liable for the loss of any content, including contributions, following the termination of access to the services and to the account.
3. Intellectual property
All content on the Site, such as texts, images, logos, graphics and videos, is the intellectual property of our company or of our partners. You may not reproduce, distribute, modify or use this content without our prior written authorisation.
Protection under trademark law: the trademarks on the media are the exclusive property of Clerice Network and its possible licensors. Under articles L.713-2 and L.713-3 of the French Intellectual Property Code, any reproduction, use, partial or total affixing, modification or deletion of trademarks and related rights by any means, in any form, on any medium and through any media, is strictly prohibited without the prior express written authorisation of Clerice Network and may lead to civil and criminal proceedings.
Any use, representation, reproduction, distribution or exploitation, in whole or in part, of the content and services provided on the media, including software, animations, icons, texts, photographs, images, videos, graphics and the general structure, is strictly prohibited without the prior express written authorisation of Clerice Network. Such actions may lead to civil and criminal proceedings. In addition, Clerice Network holds all intellectual property rights relating to electronic or paper communications addressed to users.
Most content associated with a point of interest comes from open data, and Clerice Network does not have an editorial role on this content. As a result, Clerice Network does not monitor and does not generally modify content that comes from open data, which means that it cannot be held responsible for its relevance.
4. Accuracy of the information
We make every effort to provide accurate and up-to-date information on the Site, but we do not guarantee the accuracy, completeness or reliability of this information. Tourist activities mentioned on the Site are provided for information purposes only and may be subject to changes. You are responsible for verifying the accuracy of the information before taking part in any activity or event.
5. Liability
You use the Site at your own risk. We decline all liability in case of loss, damage or prejudice arising from the use of the Site or of its content. We are not responsible for activities offered by third parties that are mentioned on the Site. You assume full responsibility for your participation in these activities.
The Yutugo® application is open to all types of users. Where the user is a minor, he or she undertakes to obtain the prior authorisation of the person or persons holding parental authority before using the services. The user declares that the person or persons holding parental authority have agreed to be responsible for ensuring that the user complies with all the conditions set out in these Terms of Use. The persons holding parental authority are invited to monitor the way their child uses the services. As legal representatives, it is up to the parents or the person or persons holding parental authority to determine which services are appropriate for their child and to monitor their use.
In case of failure to comply with the Terms, the persons holding parental authority remain responsible for the activity of their minor children. It is specified that minor users over the age of 15 are allowed to give their own consent to the processing of their personal data, in accordance with the applicable regulations.
6. Links to third-party websites
The Site may contain links to third-party websites. These links are provided for convenience only and do not imply any approval or assumption of responsibility on our part regarding the content of these third-party sites. We recommend that you consult the terms of use and privacy policy of such third-party sites before using them.
We use third-party advertising agencies to display advertisements when you visit our Site. These agencies may collect information (excluding your name, postal address, email address and telephone number) during your visits to our Site in order to display targeted advertisements about products or services that may be of interest to you. As a third-party provider, Google uses cookies to display adverts on our Site. By means of the DART cookie, Google adapts adverts shown to users based on their navigation on our Site or on other sites.
